私隱政策及個人資料收集聲明

智聊戒是一項由香港大學護理學院與香港衞生署控煙酒辦公室試行的非商業人工智能戒煙研究服務，並由香港衞生署控煙酒辦公室資助。研究團隊決定研究資料的收集及使用目的；AI Native Health Limited 按項目安排提供和維護技術系統。

ChatToQuit is a non-commercial AI smoking-cessation research service piloted by the School of Nursing of The University of Hong Kong and the Tobacco and Alcohol Control Office of the Department of Health, Hong Kong. The research team determines the research purposes for collecting and using data. AI Native Health Limited provides and maintains the technical system under the project arrangements.

視乎你的參與方式，我們可能收集：

• 姓名、電話號碼、WhatsApp 顯示名稱、研究編號及其他聯絡資料；
• 年齡及一般人口統計資料；
• 吸煙及煙草使用情況、戒煙計劃、問卷答案及相關健康資料；
• 你與聊天機械人的訊息、回覆、所提交的圖片、語音或其他媒體；
• 跟進訪問資料，以及你自願參與時的一氧化碳、可的寧測試結果和訪談錄音；
• 訊息傳送及閱讀狀態、時間、錯誤紀錄、防濫用及系統保安紀錄。

Depending on how you participate, we may collect:

• Your name, telephone number, WhatsApp display name, study identifier, and contact details;
• Age and general demographic information;
• Smoking and tobacco-use information, quit plans, questionnaire responses, and related health information;
• Messages, replies, images, audio, or other media you submit through the chatbot;
• Follow-up data and, where you volunteer, carbon-monoxide or cotinine test results and interview recordings;
• Message delivery/read status, timestamps, error records, anti-abuse records, and system-security logs.

我們只會在研究及服務所需的範圍內使用資料，包括：

• 確認參加資格、登記、身份及同意狀態；
• 提供個人化戒煙支援、跟進問卷、電話訪問及訊息提醒；
• 回應查詢、提供真人支援，以及管理退出或停止訊息要求；
• 進行研究分析、評估服務安全及成效，以及改善聊天機械人的表現；
• 維護系統安全、偵測錯誤或濫用、審計及遵守法律、研究倫理和資助要求。

We use personal data only as necessary to:

• Confirm eligibility, registration, identity, and consent status;
• Provide personalised smoking-cessation support, follow-up questionnaires, telephone interviews, and reminders;
• Answer enquiries, provide human support, and administer withdrawal or stop-message requests;
• Conduct research analysis, assess safety and effectiveness, and improve chatbot performance;
• Protect system security, diagnose errors or abuse, perform audits, and comply with legal, research-ethics, and funding requirements.

提供個人資料及參與研究屬自願性質；如你不提供研究所需資料，我們可能無法為你登記、提供部分服務或完成研究跟進。

Providing personal data and joining the research are voluntary. If required information is not provided, we may be unable to register you, provide parts of the service, or complete research follow-up.

你透過 WhatsApp 傳送的內容會經 Meta／WhatsApp 系統傳送至智聊戒。為產生回覆，與戒煙支援相關的訊息內容及必要背景資料可能由獲授權的人工智能服務供應商處理。技術及人工覆核人員只會按工作需要及獲授權的方式存取資料。

Content you send through WhatsApp is transmitted through Meta/WhatsApp to ChatToQuit. To generate responses, smoking-cessation messages and necessary context may be processed by authorised AI service providers. Technical and human reviewers may access data only where required for their authorised work.

AI 生成的內容可能不準確，並不構成醫療診斷或處方。如涉及藥物、症狀或醫療決定，請諮詢醫生或合資格醫護人員。遇有緊急情況，請致電 999 或前往急症室。

AI-generated content may be inaccurate and is not a medical diagnosis or prescription. Consult a doctor or qualified healthcare professional about medicines, symptoms, or clinical decisions. In an emergency, call 999 or attend an accident and emergency department.

在有需要及符合項目安排的情況下，資料可能提供予以下類別的接收者：

• 主要研究者、獲授權研究團隊成員及研究倫理委員會；
• 香港衞生署及其他依法或為核實研究完整性而獲授權的政府機構；
• AI Native Health Limited 的獲授權技術人員；
• Meta／WhatsApp，以及提供雲端託管、資料庫、人工智能、保安和技術支援的服務供應商；
• 依法有權取得資料的專業顧問、審計人員、監管機構或執法機關。

部分技術供應商可能在香港境外處理或儲存資料。我們會按資料的敏感程度採取合理措施，限制處理目的和存取權限，並要求相關服務供應商提供適當的保安及保密保障。我們不會出售參加者的個人資料。

Some technology providers may process or store data outside Hong Kong. We take reasonable measures appropriate to the sensitivity of the data to limit processing purposes and access, and to require suitable security and confidentiality safeguards. We do not sell participants' personal data.

根據研究同意安排，研究所收集的個人資料及數據會在研究結束後保存十年。純技術、保安或行政紀錄只會按其用途、法律及合約需要保存，之後會安全刪除、匿名化或銷毀。

Under the research-consent arrangements, personal data and research data collected for the study are retained for ten years after the study ends. Purely technical, security, or administrative records are retained only for as long as required for their purpose and applicable legal or contractual requirements, then securely deleted, anonymised, or destroyed.

我們採取與風險相稱的技術及管理措施，例如傳輸及儲存保護、存取權限控制、認證、監察和備份。沒有任何網絡或儲存系統能保證絕對安全；如發生可能對參加者構成重大風險的事故，我們會按適用規定處理及通知。

We use technical and organisational safeguards proportionate to the risk, including protections in transmission and storage, access controls, authentication, monitoring, and backups. No network or storage system can guarantee absolute security. We will manage and notify relevant incidents in accordance with applicable requirements where a breach may create a material risk to participants.

根據香港《個人資料（私隱）條例》（第 486 章），你可要求查閱及更正我們持有的個人資料。你亦可隨時退出研究或要求停止接收訊息，而無須解釋；這不會影響你原有的服務或權益。

Under Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486), you may request access to and correction of personal data we hold about you. You may also withdraw from the study or ask us to stop messages at any time without explanation; this will not affect services or rights otherwise available to you.

申請時，我們可能需要核實你的身份。法律容許的情況下，處理正式查閱資料要求或複製資料可能收取合理費用。

我們會確認收到要求、核實身份，並按適用法律、研究同意書及倫理批准處理。停止使用服務或退出研究不一定代表所有已收集資料會立即刪除；為保障研究完整性、履行法律／倫理責任或保留審計紀錄，部分資料可能需要繼續保存。不能刪除的資料會在可行情況下限制使用或去識別化，我們亦會向你解釋處理結果。

We will acknowledge the request, verify identity, and handle it under applicable law, the research consent, and ethics approval. Stopping the service or withdrawing from the study does not necessarily mean all previously collected data can be deleted immediately. Some data may need to be retained to protect research integrity, meet legal or ethics obligations, or preserve audit records. Where practicable, retained data will have its use restricted or be de-identified, and we will explain the outcome.

本政策網頁的託管供應商可能自動接收一般技術資料，例如 IP 位址、瀏覽器類型、請求時間和錯誤紀錄，以提供網站及維持保安。本網頁可能連結至 Meta／WhatsApp 或其他第三方網站；該等服務有其本身的私隱政策及條款。

The hosting provider for this policy page may automatically receive standard technical information such as IP address, browser type, request time, and error logs to deliver and secure the website. 我們可能因服務、研究安排、供應商或法律要求的改變而更新本政策。重要改動會在本頁顯示新的生效日期；如改動需要重新取得同意，研究團隊會另行通知。

We may update this policy when the service, research arrangements, providers, or legal requirements change. Material changes will be shown here with a new effective date. Where renewed consent is required, the research team will notify participants separately.
